ตามกฏหมายที่ออกมาในวันที่ 7 กุมภาพันธ์​ 2565 การจดทะเบียนบริษัทในประเทศไทยจำเป็นต้องมีผู้ถือหุ้นอย่างน้อย 2 คนตามข้อบังคับ เพราะปัจจุบันในประเทศไทยยังไม่มีการเปิดให้จดทะเบียนบริษัทคนเดียว



การแบ่งปันความเสี่ยง

• การมีผู้ถือหุ้นมากกว่าหนึ่งคน ช่วยให้บริษัทสามารถแบ่งปันความเสี่ยงทางธุรกิจได้

ความเชี่ยวชาญและประสบการณ์ที่หลากหลาย

• การมีหุ้นส่วนที่มีความสามารถในด้านต่าง ๆ เช่น การเงิน การตลาด หรือการจัดการ จะช่วยให้บริษัทสามารถพัฒนาตัวเองได้ในหลายมิติ

ความน่าเชื่อถือ

• บริษัทที่มีผู้ถือหุ้นหลายคนอาจได้รับความน่าเชื่อถือมากขึ้นจากคู่ค้า นักลงทุน หรือสถาบันการเงิน

ข้อกำหนดทางกฎหมาย

• การจัดตั้งบริษัทจำกัดตามกฎหมายของประเทศไทยต้องมีผู้ถือหุ้นอย่างน้อย 2 คน

ถึงแม้การจดบริษัทคนเดียวจะไม่สามารถทำได้ แต่มีวิธีที่ผู้ประกอบการสามารถใช้เพื่อดำเนินการธุรกิจได้ คือ การจดทะเบียนบริษัท โดยแบ่งสัดส่วนการถือหุ้นกับผู้อื่น เช่น การให้ผู้ถือหุ้นที่เป็นเจ้าของบริษัทถือหุ้น 99% ของบริษัท ส่วนคนที่ 2 ถือหุ้น 1% เพื่อคงอำนาจการควบคุมและการดำเนินการที่เกือบจะสมบูรณ์อยู่กับคุณเอง


แนวโน้มในอนาคต
ถึงแม้ว่าปัจจุบันในไทยยังไม่สามารถจดบริษัทคนเดียวได้ แต่อาจมีการเปลี่ยนแปลงในอนาคต  โดยเฉพาะการเติบโตของผู้ประกอบการรายย่อย และ การเติบโตของธุรกิจดิจิทัลและออนไลน์ที่เป็นที่นิยม งแอดมินเองคาดว่าจำนวนของผู้ประกอบการออนไลน์เองก็จะมีจำนวนสูงขึ้น ทั้งนี้ในการจดทะเบียนในรูปแบบ บจค. หรือ บริษัทจำกัด (คนเดียว) อาจจะต้องร่างกฏหมายได้รับการอนุมัติ กันต่อไปครับ
