นโยบายรัฐบาลในการขับเคลื่อนการปรับปรุงหนังสือนุญาตให้เข้าทำประโยชน์ในเขตปฏิรูปที่ดิน หรือ ส.ป.ก. 4-0 1 ให้เป็นโฉนดที่ดินเพื่อเกษตรกรรม

เเต่ที่เราจะรู้ว่าการเปลี่ยนโฉนดนั้นมีการเปลี่ยนเเปลงอะไรบ้าง เราต้องมารู้กันก่อนว่า ส.ป.ก คืออะไร ส.ป.ก คือ การปฏิรูปที่ดินเพื่อเกษตรกรรม หรือที่ดิน ส.ป.ก.4-01 คือที่ดินเพื่อเกษตรกรรมที่รัฐทำการจัดสรรให้แก่เกษตรกรผู้ไม่มีที่ทำกินของตนเอง หรือมีเพียงเล็กน้อยไม่เพียงพอแก่การครองชีพและสถาบันการเกษตร ซึ่งทางรัฐให้ความช่วยเหลือในการพัฒนาอาชีพเกษตรกรรม ให้มีการใช้ทรัพยากรจากพื้นที่ ผลิตจำหน่ายให้เกิดผลผลิตที่ดี

ผู้ที่ได้รับสิทธิ์การเปลี่ยน ส.ป.ก. เป็นฉโนดที่ดิน 2566
เกษตรกรที่ถือเอกสารสิทธิ์ สปก. อยู่แล้ว และยังใช้ประโยชน์ในพื้นที่นั้น ต่อเนื่องมา 10 ปีขึ้นไป จะได้รับการเปลี่ยนเป็นโฉนดที่ดิน ภายในระยะเวลา 2 ปี
โดยได้รับสิทธิ์ตามเอกสารสิทธิ์ที่ตนถืออยู่ แต่จะยังไม่ซื้อขายที่ดินดังกล่าวได้ในระยะเวลา 5 ปีจากวันที่ได้รับโฉนด
หากในกรณีที่มีความจำเป็นในการกู้ยืม (การจำนอง) หรือจำเป็นจะต้องขายที่ดินที่ได้รับโฉนดนั้นก่อนเวลา 5 ปี ให้ดำเนินการผ่านธนาคารที่ดิน (ที่จะจัดตั้งขึ้น) โดยธนาคารที่ดินจะคิดราคาที่ดินตามราคาประเมินของที่ดินที่มีโฉนด
ส่วนเกษตรกรที่ยังไม่ได้เป็นผู้ถือเอกสารสิทธิ์ในที่ดิน สปก. (หรือเป็นผู้ซื้อ/เปลี่ยนมือที่ดิน สปก. นั้น) เกษตรกรจะได้รับการเปลี่ยนเป็นโฉนดที่ดิน หาก (ก) เกษตรกรมีการใช้ประโยชน์ที่ดินในการทำการเกษตรต่อเนื่องมา 10 ปีขึ้นไป และ (ข) มีเอกสารหรือพยานการทำข้อตกลง/การยินยอมจากผู้ที่มีชื่อในเอกสารสิทธิ์ สปก. รวมถึง (ค) เกษตรกรผู้นั้นจะต้องเป็นผู้ที่มีทรัพย์สินไม่เกิน 10 ล้านบาท เกษตรกรดังกล่าวจะสามารถเปลี่ยน สปก. เป็นโฉนดได้ไม่เกิน 50 ไร่

ระเบียบฯ การเปลี่ยน ส.ป.ก. เป็นฉโนดที่ดิน 2566
เกษตรกรหรือสถาบันเกษตรกรผู้ได้รับมอบที่ดินให้เข้าทำประโยชน์ในที่ดินมีหน้าที่ปฏิบัติ ดังต่อไปนี้

(1) ต้องทำประโยชน์ในที่ดินด้วยตนเองเต็มความสามารถ และไม่นำที่ดินนั้นทั้งหมดหรือบางส่วนไปให้บุคคลอื่นไม่ว่าจะโดยการขาย ให้เช่า หรือเข้าทำประโยชน์ หรือโดยพฤติกรรมใดๆ ที่แสดงให้เห็นในลักษณะนั้น เว้นแต่ได้รับความยินยอมจาก ส.ป.ก. ทั้งนี้ ไม่รวมถึงกรณีการโอนให้เป็นไปตามที่ระเบียบคณะกรรมการปฏิรูปที่ดินเพื่อเกษตรกรรม ว่าด้วยหลักเกณฑ์ วิธีการ และเงื่อนไขในการคัดเลือกและจัดที่ดินให้แก่เกษตรกร การโอน หรือตกทอดทางมรดกสิทธิการเช่าหรือเช่าซื้อและการจัดการทรัพย์สินและหนี้สินของเกษตรกรผู้ได้รับที่ดิน พ.ศ. 2564 กำหนด
ห้ามมิให้ผู้ได้รับโฉนดเพื่อการเกษตรเปลี่ยนมือ สละสิทธิ หรือกระทำการอื่นใด เพื่อให้บุคคลอื่นได้รับสิทธิในโฉนดเพื่อการเกษตรแทนตน ภายในสองปี นับแต่วันที่ออกโฉนดเพื่อการเกษตร เว้นแต่เป็นการจัดที่ดินแทนที่แก่คู่สมรส บุตร เครือญาติหรือทายาท

(2) ยินยอมทำสัญญาเช่า หรือสัญญาเช่าซื้อ หรือสัญญาจัดให้ โดยมีค่าชดเชยและต้องปฏิบัติตามสัญญาดังกล่าว
(3) ไม่เปลี่ยนแปลงสภาพที่ดิน จนเป็นเหตุให้ที่ดินเสื่อมสภาพความเหมาะสมแก่การประกอบเกษตรกรรม
(4) ไม่ขุดบ่อเพื่อการเกษตรกรรมเกินร้อยละห้าของเนื้อที่ที่ได้รับมอบ
(5) ไม่ปลูกสร้างสิ่งก่อสร้างใด ๆ เว้นแต่การปลูกสร้างตามสมควรสำหรับโรงเรือนที่อยู่อาศัยยุ้งฉาง หรือสิ่งก่อสร้างอื่น ๆ ที่ใช้ประโยชน์เพื่อการเกษตรของเกษตรกรหรือสถาบันเกษตรกรนั้น
(6) ดูแลรักษาหมุดหลักฐานของ ส.ป.ก. และหลักเขตที่ดินในที่ดินที่ได้รับมอบมิให้เกิดชำรุดเสียหายหรือเคลื่อนย้ายไปจากตำแหน่งเดิม
(7) ไม่กระทำการใดๆ ในลักษณะที่ก่อให้เกิดความเสียหายแก่สิ่งก่อสร้างในโครงการปฏิรูปที่ดินเพื่อเกษตรกรรม การทำประโยชน์ในที่ดินของเกษตรกรอื่นและสภาพแวดล้อม
( ปฏิบัติตามมติของคณะกรรมการ คณะกรรมการปฏิรูปที่ดินจังหวัด รวมทั้งคำสั่งของเลขาธิการหรือผู้ซึ่งเลขาธิการมอบหมาย
(9) ปฏิบัติตามสัญญากู้ยืมที่ทำกับ ส.ป.ก. และปฏิบัติตามพันธกรณีที่มีอยู่กับสถาบันการเงินหรือบุคคลที่ดำเนินงานร่วมกับ ส.ป.ก

วิธีการเปลี่ยน ส.ป.ก เป็นฉโนดที่ดิน ปี 2566
